1. Parties, scope and acceptance

1.1 These Terms form an agreement between the customer (you) and K2026684028 (SOUTH AFRICA) (PTY) LTD, registration number 2026/684028/07, trading as Paper Kite Learning (we, us or our), for each purchase from our website, Payhip store or another approved sales channel.

1.2 By placing an order, completing payment, accessing a download or using a purchased product, you confirm that you have reviewed and accepted these Terms, the product description and any product-specific terms shown before payment. The preferred checkout statement is: "By completing your purchase, you confirm that you have read and agree to the Paper Kite Learning Terms and Conditions and acknowledge the Privacy Notice."

1.3 Mandatory consumer rights prevail over any inconsistent clause. Payhip or another platform may also apply its own checkout, payment, privacy or end-user terms. Those platform terms govern the platform service; these Terms govern your relationship with Paper Kite Learning and your permitted use of our content to the extent allowed by law.

2. Definitions

TermMeaning
CustomerThe purchaser and, where a parent or guardian purchases for a learner, that purchaser acting for the authorised learner.
ProductA digital downloadable PDF resource pack described on the relevant Product Page.
Digital ContentThe PDF files and related electronically supplied content included in the purchased Product.
Authorised LearnerThe single learner for whose personal educational use the product was purchased, unless a broader licence is expressly stated.
Product PageThe page or checkout description identifying the product's scope, version, format, price and special terms.

3. Eligibility and purchases for learners

3.1 You must have legal capacity to contract. A minor may use a product only with the involvement and consent of a parent, guardian or other competent adult where required.

3.2 A parent or guardian may purchase and administer the product for one authorised learner. The purchaser is responsible for explaining the relevant licence and safe use requirements to that learner.

4. Product information and versions

4.1 The Product Page is the controlling description of what is included. Before checkout, it must identify the subject, grade, paper, language, resource type, digital PDF format, included documents, relevant version or edition where applicable, price, currency, tax treatment, delivery method and timing, refund and support route, and licence conditions. Please check these details and any device or software requirements before paying.

4.2 Preview pages and images are illustrative but must fairly represent the product. Minor pagination, formatting or file-name differences that do not reduce the product's educational function are not a material mismatch.

4.3 Curriculum and assessment sources may change. Alignment statements relate to the sources and version identified for the product at release. Paper Kite Learning does not guarantee that a purchased version will remain current indefinitely.

5. Prices, taxes and payment

5.1 The current standard price is R149.99 per resource pack in South African Rand (ZAR). The complete price payable must be displayed before checkout. Paper Kite Learning is not currently VAT registered, so no VAT is currently charged. Paper Kite Learning currently charges no additional compulsory customer fees.

5.2 A bank, card provider, Payhip, Paystack or another third party may independently impose a charge outside our control. Such a charge is not a Paper Kite Learning product fee. If our price or tax status changes, the amount and treatment shown before payment apply to that order.

5.3 Payment must be completed using an approved method. Current checkout is intended to operate through Payhip, with Paystack once approved and activated. We may decline or cancel an order affected by an obvious pricing error, suspected fraud, unlawful activity or a failed or reversed payment. If we cancel after receiving cleared funds and no product has lawfully been retained, we will arrange the appropriate refund.

5.4 Card and payment-account data are processed by the platform or payment processor under its own terms and privacy notice. We generally receive transaction and customer details needed to fulfil and support the order, not full card credentials.

6. Order confirmation and contract formation

6.1 You must have an opportunity to review and correct the order before final submission. A purchase is confirmed when approved payment is accepted and Payhip makes the Product available or otherwise confirms the order, unless the confirmation states otherwise.

6.2 Keep the receipt or order confirmation, order reference, purchase email and a copy of these Terms. Paper Kite Learning will use Payhip records, applicable payment-processor records and its internal records to maintain transaction information. The final checkout must be verified to ensure that the customer receives an order record that can be retained or reproduced.

7. Digital delivery and access

7.1 The purchased digital resource will normally be available for download immediately after successful payment through Payhip, subject to payment processing and Payhip platform availability. Delivery may be affected by payment review, internet failure, an incorrect email address or platform downtime.

7.2 You are responsible for providing a correct email address, checking spam or junk folders, maintaining compatible software and sufficient device storage, and making a lawful personal backup after download.

7.3 If access is not received within a reasonable period, contact info@paperkitelearning.co.za with your name, purchase email, Payhip or order number, product name and a description of the problem. We aim to respond within 2 business days, but this is a target rather than an absolute guarantee. Do not send card numbers or account passwords.

7.4 Download links, access limits and account availability may be controlled by the platform. A platform interruption does not transfer ownership of the content or permit a chargeback where we are reasonably able to restore lawful access.

8. No physical delivery unless stated

Current resource packs are digital downloadable PDF products only. No printed book, courier delivery, editable Word file, storage device or other physical item is included unless the Product Page expressly says otherwise. Physical printed products are not currently offered and are not planned.

9. Licence granted

9.1 After full payment, we grant the customer and one authorised learner a limited, personal, worldwide, non-exclusive, non-transferable, non-sublicensable and non-commercial licence to use the purchased product for that learner's own education, subject to these Terms.

9.2 The product is licensed, not sold. Copyright, trade marks, design rights and all other intellectual-property rights remain with Paper Kite Learning or the identified rights holder.

9.3 Unless the Product Page grants a broader licence, the licence permits you to:

  • download and store the files on devices reasonably used by the purchaser or authorised learner;
  • keep a private personal backup that is not accessible to unauthorised third parties;
  • print copies reasonably required for the authorised learner's personal educational use; and
  • allow a parent or guardian to assist the authorised learner with the product.

10. Prohibited use

10.1 You may not, without prior written permission or a separate appropriate licence:

  • share the files, download link, account access, answer material or substantial extracts with another learner, teacher, tutor, class, school, organisation or online group;
  • copy, upload, publish, broadcast, email, message, distribute, lend, sell, resell, rent, sublicense, repackage, modify for resale, commercially reproduce or otherwise commercially exploit any part of the product;
  • remove or obscure copyright, licence, brand, authorship, watermark or version information;
  • present Paper Kite Learning materials, or an unauthorised adaptation of them, as another person's work;
  • upload the product to a WhatsApp group, Google Classroom, Microsoft Teams, school learning-management system, shared Google Drive or cloud folder, email distribution list, public or private website, social-media group, file-sharing service or any other system through which an unauthorised person may obtain it; or
  • use assessment or memorandum content to facilitate cheating, impersonation, dishonest submission or unauthorised disclosure of an unseen task.

10.2 School, tutor and institutional licensing is planned but is not currently included in or offered under the standard retail licence. A teacher, tutor, school or institution may not purchase one retail copy for use by or distribution to multiple learners. Any broader use requires a separate appropriate written licence from Paper Kite Learning.

11. Educational use and academic disclaimer

11.1 The products are educational support materials. They do not replace a learner's school, teacher, official curriculum documents, professional advice or responsible exam preparation.

11.2 We aim for accurate, current and appropriately aligned content, but no educational resource can guarantee a mark, promotion, admission, examination outcome or improvement. Results depend on the learner's prior knowledge, effort, use of the pathway and wider circumstances.

11.3 Paper Kite Learning resources are independently created and are not official DBE examination papers and are not endorsed by the Department of Basic Education unless we expressly provide written evidence of that status.

12. Refunds and remedies

12.1 Because Digital Content can be retained and copied after access, a change-of-mind refund is generally not available once the customer has downloaded or accessed the files, to the extent permitted by law. If the customer has not downloaded the product, a cancellation request should be made promptly and will be assessed under applicable law and the checkout platform's process.

12.2 This does not remove rights that cannot legally be excluded. We will investigate and, where appropriate, provide restored access, a corrected or replacement file, or a refund for:

  • a duplicate charge or clearly duplicated purchase;
  • non-delivery that we and the platform cannot remedy within a reasonable time;
  • an inaccessible, defective, corrupted, incomplete or materially unusable file that cannot be replaced;
  • a materially incorrect Product supplied for the order;
  • a product that is materially different from its description; or
  • another circumstance in which a refund or remedy is required by applicable consumer law.

12.3 Send the request to info@paperkitelearning.co.za with your name, email address used for the purchase, Payhip or order number, product name and enough information to explain the problem. We aim to respond within 2 business days, but this is a target rather than an absolute guarantee. We may reasonably verify download status and attempt a technical remedy before deciding the request.

12.4 A refund will normally be returned through the original payment route and may take additional processing time imposed by the payment provider. Nothing in this section limits rights under the Consumer Protection Act, the Electronic Communications and Transactions Act or other applicable law.

13. Corrections and product updates

13.1 Please report a suspected academic, notation, marking, file or production error. We may investigate, issue a correction notice or provide a corrected file. Reporting an issue does not transfer ownership of the product or create a right to compensation beyond applicable law.

13.2 A purchase gives access to the version bought and any correction we elect or are required to provide for that version. It does not include every future edition, new product, curriculum revision or expanded bundle unless the Product Page says so.

14. Customer responsibilities and security

  • Use truthful billing and contact details and keep the purchase email and platform account secure.
  • Do not share download links or credentials, and notify us promptly of suspected unauthorised access.
  • Use current security software and scan downloaded archives where appropriate.
  • Keep a lawful personal backup; do not rely on indefinite platform hosting as the only copy.
  • Respect school rules, assessment integrity, intellectual-property rights and all applicable laws.

15. Privacy and communications

15.1 We process personal information reasonably needed for orders, downloads, fraud prevention, support, transaction records and legal compliance. This may include a name, email address, order and product details, correspondence and technical access records.

15.2 Payhip, Paystack once activated, email providers and other necessary service providers process information under their own privacy notices. Information may be stored or processed outside South Africa subject to applicable safeguards.

15.3 Marketing consent is separate from transactional communication. Customers may unsubscribe from optional marketing; essential order, security, correction and service notices may still be sent where lawful.

15.4 Where a learner is a child, a parent or competent person should manage the purchase and personal information supplied, unless a lawful service process states otherwise.

16. Tutoring and other services

16.1 A digital-resource purchase does not include tutoring, marking, personalised feedback, live support, membership, subscription access or institutional use.

16.2 Online tutoring, subscriptions or memberships, and school or institutional licensing are planned but are not currently offered under these Terms. Separate service-specific terms must be published before any of those services opens for paid public use. Physical printed products are not planned, and no other paid services are currently identified.

17. Availability and third-party platforms

17.1 We cannot guarantee uninterrupted availability of a website, payment gateway, download host, email service or platform. We will use reasonable efforts to restore access or provide another lawful delivery route after a verified outage.

17.2 References to Payhip or another provider do not make that provider the owner or author of Paper Kite Learning content. Customers must also comply with the provider's lawful terms.

18. Liability

18.1 To the fullest extent permitted by law, we are not liable for indirect, special or consequential loss arising from reliance on a product, platform interruption, incompatible software, unauthorised sharing, data loss or use outside the stated purpose.

18.2 Where liability may lawfully be limited, our aggregate liability for a purchase will not exceed the amount paid. This limit does not apply to non-excludable liability, including applicable liability for fraud, wilful misconduct, gross negligence or mandatory consumer rights.

19. Suspension or termination

We may suspend access, revoke a licence or take reasonable enforcement steps after payment reversal, unlawful access, redistribution, intellectual-property infringement or another material breach. Lawfully earned refund and consumer rights remain unaffected.

20. Complaints, governing law and jurisdiction

20.1 Contact info@paperkitelearning.co.za first so that we can investigate and try to resolve the matter. Include the order reference and the outcome requested.

20.2 These Terms are governed by the laws of the Republic of South Africa. South African courts have jurisdiction, subject to any consumer's non-excludable right to use another competent forum, regulator, ombud or dispute-resolution process.

21. Changes to these Terms

We may update these Terms for legal, platform, product or operational reasons. The version accepted at the time of purchase normally governs that transaction. A later version will not remove an accrued right or retrospectively impose a material disadvantage where the law does not allow it.

22. General legal provisions

22.1 If one clause is invalid or unenforceable, it will be limited or removed only to the necessary extent; the remaining clauses continue to apply.

22.2 A delay in enforcing a right is not a waiver. A waiver must be clear and applies only to the specific instance.

22.3 We may use service providers to perform payment, hosting, email, administration and support functions. We remain responsible for our own obligations to the extent required by law.

22.4 These Terms, the Product Page, checkout confirmation and applicable product-specific terms form the agreement for the purchase. No informal statement changes it unless confirmed by an authorised representative or required by law.
